Haitian TPS (Feb 2026):

As of February 10, 2026, a U.S. District Court judge has blocked the Department of Homeland Security’s (DHS) scheduled February 3, 2026, termination of Temporary Protected Status (TPS) for Haiti. This court order preserves TPS and work authorization for beneficiaries for now, putting the termination on hold while litigation proceeds. 

Key Updates on Haiti TPS (Feb 2026):

  • Termination Stayed: The planned Feb. 3, 2026, termination has been halted by a federal judge in Washington, D.C..
  • Immediate Impact: Beneficiaries do not immediately lose their status, and existing Employment Authorization Documents (EADs) are protected.
  • Litigation Status: The court order is a temporary halt (stay) and not a final judgment, meaning the situation is subject to change if higher courts intervene or the administration appeals.
  • Ongoing Uncertainty: Despite the stay, the administration previously cited a November 2025 notice to terminate the program, creating ongoing concern for the estimated 300,000+ eligible individuals.
